I can't recall the exact specifics of my accident a few years back but I think Geico (other insurance company) offered me "pain and suffering" of like $4-500. I drug them along for several months, wrote them a letter with my estimates of about $5-6K. They ended up countering with $1000 or so. It had been long enough, and I was itching for a new range toy, so I ended up taking it. I'm sure I could have gotten more, but I also wanted to put it behind me.
The longer you can hold out, the more they will probably offer to settle. I even checked with a lawyer. When I asked questions about their "contract", they decided not to take my case (Jacobs & Jacobs if you want to know who to avoid).
