 Advice on arguing with insurance companies

I can't recall the exact specifics of my accident a few years back but I think Geico (other insurance company) offered me "pain and suffering" of like $4-500. I drug them along for several months, wrote them a letter with my estimates of about $5-6K. They ended up countering with $1000 or so. It had been long enough, and I was itching for a new range toy, so I ended up taking it. I'm sure I could have gotten more, but I also wanted to put it behind me.

The longer you can hold out, the more they will probably offer to settle. I even checked with a lawyer. When I asked questions about their "contract", they decided not to take my case (Jacobs & Jacobs if you want to know who to avoid).

A lawyer makes a huge difference when taking on an insurance company. The downside is you will probably pay more then you would gain unless there is serious injury. Unless there is money in it a good law firm won't take on small cases

I negotiated an extra 1500 out of my insurance company by getting my own comps. Do not reduce by 20-25%. The price is the price. Tell them you refuse to take less. Then drop them after they pay out.

This. Not that it does much good, but remind the insurance company they are already taking the lower cost option relative to the high cost of repair.

I had a 2001 Camry that was totaled in a rear end collision. The other guys insurance sent me 10 comps and offered the average price (about 4.5k). This would only allow me to purchase the (bottom) 50% of the market. I found 10 comps (identical make/model and same or higher miles) and payed more than 2k more.

Use autotrader, craigslist, etc to search all the crappy little dealerships with overpriced cars. If I remember right, the recourse under state law is some kind of arbitration but it's hard for them to argue with an average of comps.

As a claim adjuster for a insurance company. A lawyer wont take your case for the car. The money is in the bodyily injury claim.

Also on the comps are feature heavy. So if the comp has power seats and yours doesn't -$250. They should have a list of features that you have or dont have then a total the difference. It also has to do with the condition of the car. If the seats are heavily soiled, then money off for that.

The also pull comps from those small mom and pop dealerships that sell at lower prices than name brand dealerships.

This does not work. Some time ago I had an accident in my convertible and they tried to total it and pay me less than half the value. I called the insurance Commisioner and they said there was not much they could do but if I wanted they could send me some pamplets on insurance rules. The insurance company was trying to use comps on cars that were in the wrecking yard too. Since there were only 366 of the year and model I had and there was a close knit group for those convertibles I was able to track all that were for sale and most were in wrecking yards. I called the agent handling my case at every lunch break and when I got home to argue with him for almost 2 weeks. He got tired of it and finally gave me the name of a body shop and told me to take it there and they would have it taken care of.
