I'm going to run this by my ATF contact - it'd be interesting to hear how they construct the argument against it, if there is one.

UPDATE: ATF confirmed that a shotgun with one short barrel and one long barrel is an SBS. I didn't get a detailed explanation as to why, but it was the answer I expected based upon my own interpretation of the law.

Because one barrel is shorter than 18" :thumbsup2:

It does meet the OAL, but because bits come out at an earlier point, its now a SBS. Dumb, just like the rest of the NFA.

It's actually pretty simple why it's considered a SBS. Remember that as much as we bitch about the ATF, they are over 90% black and white. Arbitrary, but not very capricious. Keeping that in mind, what is the exact wording of the definition of a SBS?
It's "having one or more barrels less than eighteen inches in length." That's it. They ATF rarely plays the, "what if," "what about," or whatever games. Is it A or is it B? Does it meet this exact wording? Yes or no. Regardless of how silly it seems they do the exact word thing.
Of course there are exceptions, the SIG brace the most recent and well known.
