"A three-judge panel of the Fifth Circuit Court of Appeals upheld the conviction of Zachary Rahimi for possession of a firearm while under a domestic violence restraining order. That, however, was before the Bruen decision was handed down by the Supreme Court..."

"...Today, the panel unanimously reversed and vacated Rahimi’s conviction, ruling that the law banning possession of a firearm while under a domestic violence restraining order fails the Bruen test. The panel ruled that, “The Government fails to demonstrate that § 922(g)(8)’s restriction of the Second Amendment right fits within our Nation’s historical tradition of firearm regulation.”

There's two very key things in that article, the first being this snip-it from the second judges explanation: "Our Founders understood that those who commit or threaten violence against innocent law-abiding citizens may be arrested, convicted, and incarcerated. They knew that arrest and incarceration naturally entails the loss of a wide range of liberties—including the loss of access to arms."

The second coming from the TTAG writer: "But if screeching harridans like Shannon Watts are upset by this outcome, they should direct their displeasure at the prosecutors and the fact that Rahimi wasn’t tried, convicted, and jailed on a slew of potential felony charges during which a firearm was used illegally."

In other words the prosecutors need to sack up and actually charge these criminals according to there acts.

DOJ asks SCOTUS to review ruling that overturned firearm ban for those with domestic violence restraining orders
https://thehill.com/regulation/court-battles/3907017-doj-asks-scotus-to-review-ruling-that-overturned-firearm-ban-for-those-with-domestic-violence-restraining-orders/

Quote:
The Fifth Circuit Court of Appeals ruled in February that the law was no longer constitutional based on the Supreme Court’s decision last June in New York State Rifle & Pistol Association v. Bruen, which found that gun regulations had to be consistent with the country’s historical tradition.

The DOJ filed its petition with the high court on a “highly expedited schedule” — citing the “significant disruptive consequences” of the appeals court ruling — in an effort to allow the court to consider the petition before it recesses for the summer.

That Redmond podcaster had a no-contact order against her killer, so these court orders are timely and super effective, yes? (sarcasm)

I read about a previous DV event where the ex-girlfriend claimed her ex came to her house and threatened her. She totally skipped over the part where she went over to his home and pounded on the door, and screamed at him expletives & threats.

Due process, indeed.
