if they get NFA'ed can you just remove the brace and instantly be complaint back to a pistol? shouldering the buffer tube doesn't seem too comfy.

They can always go after you with constructive possession for owning a pistol AR and brace (once it's disallowed), but probably unlikely unless you were committing another crime.

Not supposed to be shouldered is the issue, just a cheek weld if not actually braced against forearm is my understanding. That's where I think they went wrong by using the adjustable buffer tubes. In their minds makes it easier to replace quickly with a regular stock as opposed to the true pistol buffer tube which is just a smooth round tube. The whole thing is just stupid. They made a decision somewhere along the line that an "incidental" shouldering did not change the true intended purpose of a brace, yet
now seeking a total ban.

IMHO, just another example of pushing the line and ruining it for everyone.

Meh . . . go back in time a few years, and that's how we all did it. Well, sometimes you could shoulder the buffer tube, but in theory you just put the buffer tube against your cheek (just like it fits when using a stock), and went for it.

Yeah, it's not ideal. But it works for wussy calibers like 5.56.

The ATF actually clarified that shouldering the brace doesn't change the intent of the design

Biden directed DOJ to publish standards for when a brace turns a pistol into an SBR. This was due a couple days ago...

According to the statement...

Agency/Subagency: DOJ / ATF
Major: Yes
Received Date: 05/17/2021
Stage: Proposed Rule
Concluded Date: 06/04/2021
Economically Significant: Yes

After all, here in WA we will not be able to carry loaded AR, AK, etc. pistols in our vehicles.

So, if you have a hand stop, and a side folding adapter, even with a brace that doesn't meet any of their criteria, you have an SBR.

If you have a second grip, it's an SBR.

Fuck these guys.

and, get this...

" Presence of Rifle-type Back-up / Flip-up Sights / Or no sights" 1 point

So, if you HAVE sights, you get a point. If you have NO signts, you get a point.

The penalty for sights is to level the playing field. Criminals don’t use sights during their drive bys so why should anyone else. Redistribution of marksmanship.

So, basically, even IF you follow their directives, and pass the 'points test', they can still arrest you and charge you with unlawful possession of an SBR... if they feel like it..
