Started a Handgun BGC with Sportman's Warehouse in Everett on 11/23/2021. Yesterday (12/12/2021) I stop by to let them know the BGC is well past 10 business days and I had received two other proceeds in the last two weeks in under a week. They state company policy they cannot release unless they get a proceed. I called SW corporate for another matter and confirmed they do not release until they get a proceed. Well I just got off the phone with SnoCo Records department and they issued the proceed on 12/3/2021 and have the store call them directly. Called SW right after to let them know they needed to contact SnoCo and call me back. I'm a it pissed right now and SW will get a piece of my mind when I go and get my pistol.

Why I called SW corporate was because I did not receive a credit for an item I had shipped to the Everett store and quickly cancelled online on 11/19/2021. SW corporate said the store received the cancellation request but did nothing with it. The SW corporate CS person called the store and had the order cancelled and refunded to me while I was on the phone. Thanked her and she sent me a 10% off code.

Looks like SW Everett is on my shitlist for two separate reasons and I will be spending time with their management to provide recommendations on their SOPs.

Moral of the story: Call the LEO agency your BGC was sent to if the FFL gives you the runaround. All SnoCo needed was firstname, lastname, the FFL who submitted it and the date the BGC was submitted. I was very patient and polite while on the call and thanked the person profusely. YMMV

More to come...

Update #1: 2.5hrs later I get the call from the store telling me they got the proceed. Amazing.

Update #2: Completed the transfer then asked to speak with a Manager but got the gun counter lead instead. While I was waiting fo the lead, he was on a call with a customer I the same predicament as me. 10 business days have past and customer on the phone got the "we cannot release until we get a proceed", customer was told to call back in a few days. Lead then spoke to me. I advised him I wasn't asking for a policy change and only wanted to recommend updating their procedures. I recommended they call LEO if they have not received a proceed in the event the proceed was lost or BGC never received. Lead started to get frustrated and said he can't do anything and they were too busy to call LEO. Also said their fax machine was crap and didn't work some/most of the time. I then asked to talk to someone who could make procedural changes Long story short, the store manager said he would not change procedures as they do not call LEO and refused to. In the end I told the store manager a local government agency was easier to work and more responsive then his store.

Easier to check the FFL thread here, or check company policy before directing your firearm to a certain FFL. Big box stores are notorious for these various policies.

This was for an in-store purchase and they refuse to send it to another FFL to process unless you are at minimum 50-miles from the nearest store.

BTW - Comment about Big Box is not entirely true. Friend works at Sportco in Fife and they release after 10-business days if they do not receive a delay. To release earlier than 10-business days they need the proceed. Either way, big box or not someone can check the status of their BGC if they call LEO in their jurisdiction. It is how the FFL handles the issue when it is presented to them and in my case, I called Friday and they said "No proceed received". Walked in on Sunday and still no proceed. I even told them I had two proceeds in the last two weeks taking less than a week each. Miraculously, called Monday and told them SnoCo sent the proceed on 12/3 did SW ever do anything. It seems their only response is "We do not have a proceed yet" but do nothing and in this case, it was their fault as the proceed was sent and SW lost it.

Okay! Well, it sucks to have those problems. I would recommend finding an FFL you trust, but the small guys don't always have the items you want in their inventory.

Sound Loan in Everett is my go to. Jeff has been doing my transfers since 2008. Sportsman''s Warehouse just happened to have what I wanted and for the price I wanted to pay. Will be think twice next time.

Here is the irony. Just as mustangfreak described above their quirky process is painstakingly slow but yesterday when I was voicing my frustration they didn't follow any of those processes. They didn't even red tape the case or escort me to the front of the store. They definitely wanted me out of there.

Shameless plug for Sound Loan: Cassie is getting her FFL-SOT so they will be doing Form 3 and 4 transfers soon.

Damn. Sounds like buying at Cabela's, or at least the way it used to be -- I haven't bought anything there in a looong time.

And yeah, to echo 3584ELK's words, do business with an FFL you know and trust if you can, one that will follow the 10-day release law. Yes, LAW. If it goes past 10 days, it may be a simple matter of them not receiving the response from the LEA, but sometimes the LEA just doesn't provide a response and you're stuck. I've heard waaaay too many stories of that happening, and people waiting 1-3 months for their guns. Eff that.

Was WA law ever updated or officially interpreted to require the FFL to release after 10 business days if no denial or hold was issued? Can't recall.

I do not interpret the RCW as requiring a FFL to release after 10-days. That is why I did not argue the store policy. My issue is with their procedures.

My understanding of the RCW is a FFL must hold handguns/semi-auto rifles until:
A. < 72 hrs LEA must inform FFL of denial/disqualification
B. < or = 10 days or receives a proceed from LEA
C. > 10 days the FFL may release if a proceed is not issued
D. > 10 days LEA is required to notify FFL of a 30 and 60 day hold due to investigation

Condition A and D were not met and SW was doing nothing. As stated, LEA sent SW a proceed on day 4 and they lost it. I showed the store manager the RCW and he refused to even look at it. He could have diffused the situation by adding one step to their procedure (call LEA on day 10) or say "I'll talk to corporate". He refused to do anything.

Shall is pretty clear. Too bad we don't have a decent AG in this WA who could issue an opinion on that to one of the few decent legislators who'd be privileged to request it. Also ridiculous there was no penalty written into the law, now it will take a lawsuit pointing to A1Sec24 of the state constitution, but given that some large retailers are doing this and they have money for damages, maybe SAF would take a case like that.

One of you guys who's been illegally delayed by a big box corporate chain needs to call SAF.

Sportsman's has gone downhill ridiculously fast. I no longer shop there. Their processes do now seem to take more time than Cabela's ever did. They used to have some good people behind gun counter at Sportsmans in Everett but in 2021 it sure seems like they all left. Sadly, I think the store personnel are doing the best they can, they just have no ability to make any changes due to corporate idiots.

tl/dr - avoid Sportsmans at all costs.
