Hello,
As your constituent I respectfully request your attention regarding the following upcoming firearm-related legislation.
HB-1178 would create a patchwork of gun laws across the state, placing any gun owner traveling within the state at risk of running afoul of any city, county, or municipality's unique gun laws. Removing preemption has caused serious challenges for lawful and responsible gun owners in Colorado. Don't let Washington copy their mistakes and make an already complicated legal topic even more challenging to comply with.
HB-1143 and HB-1144 directly conflict with the Supreme Court's repeated affirmation that “no state may erroneously convert a secured liberty into privilege, and issue a license and a fee for that license.” (Shuttlesworth vs Birmingham, 1969 United State Supreme Court).
HB-1240 is a grossly inaccurate piece of legislation on many levels. The most apparent flaw is that Heller v United States determined the only conditions under which the government can restrict the right to keep and bear arms is for weapons that are (a) not in common use and (b) are both dangerous and unusual. There are millions of firearms in possession of law-abiding citizens that meet this bill's contrived and erroneous definition of "assault weapon", which more than satisfy the "common use" standard. Furthermore, the claim of an emergent need to implement this legislation is patently and demonstrably false. There is no "emergency" at play, just a poorly conceived attempt to address a specific type of criminal activity, one which accounts for less than 0.03% of all gun-related crime in the state. ⁰Even if this bill is enacted into law, it will have absolutely zero effect on deterring mass shootings because the millions of existing semi-automatic firearms that this bill seeks to make illegal will remain in current owners' hands.
HB-1195 creates an overly broad definition of "sensitive places" which has been struck down by the courts repeatedly. It also eliminates hunting and hunting access statewide.
All of these bills will be challenged in court if they become law, and based on numerous precedent supreme court cases the challengers will undoubtedly succeed in overturning them. Consequently, enactment would result in millions of dollars in taxpayer funds being spent wastefully in legal defense of indefensible positions.
For all of the above reasons, and numerous others that I won't bore you with, please vote NO on these bills.
There are countless ways we can address gun violence while still respecting law abiding citizens' constitutional rights, ways that would be infinitely more likely to succeed than these measures. Please feel free to reach out if you have any questions about firearms and ways to stem gun-related violence in our communities. I would be more than happy to consult and offer suggestions that would garner bipartisan support and actually help address the problem.
