Worded vaguely enough where the title is good click bait. I'd think that ANYBODY would be subject to arrest if they fail to abide by the house rules or if they refuse to leave when asked. Also, 22-3302 give authority for arrest for trespass, NOT for failure to mask. So, you won't get arrested for not masking, you will get arrested for not leaving if you refuse to mask.

Also worth pointing out the hypocrisy that Staffers and Public are subject to arrest, but Members of Congress just get tattled on and not arrested. Um, how's that #privilege treating you?

I believe that Members of Congress are fined. The fine automatically gets taken out of the paycheck so they can't appeal it.

As far as being arrested for trespass instead of not masking, our local sheriff has talked about this. Police authority (at least in Colorado) comes from very specific sections of law from the state legislature. There is a separate section for Public Health - that is under the authority of the Colorado Dept of Health. This section is separate - therefore, the sheriff can't arrest anyone who breaks those laws. The Dept of Health doesn't have as much "teeth" to enforce their laws. They can only ask the sheriff to arrest due to something similar on the law enforcement side. (BTW - our sheriff gave a big FU and refuses to use their resources to enforce the Dept of Health unconstitutional laws here. :bigsmile: ) Of course, Denver is a bastion of progressive craziness so they will do this.
