When Guns Are Wrongly Destroyed, Should Cops Pay or Replace? I knew a USCG petty officer in the early 80's off the Polar Star, arrested by SPD for pointing his grandfathers vintage 1911 at a guy who tried to rob him. He had a CWP. No charges were filed, but SPD thoughtfully engraved the case number on both the slide and frame of his gun which he had to go to court to get back. |

You can't replace a family heirloom, so they should pay fair market value. If the courts decide that it was malicious or negligent, other penalties should apply. |
