To be fair, the NFA and GCA were written and passed by Congress; ATF is just tasked with enforcement and rule-making within the confines of those laws. I realize it doesn't make the "rules" any less asinine, but let's lay the blame where it really belongs.

Yes, both of those acts defined certain firearms, thereby creating the classifications. The rules for use and obtainment are more the result of administrative rule-making.
