Can a friend FFL mail a gun I own to me in a different state

Thu Mar 23, 2017 11:30 am

I moved from WA to AZ a few months ago. Have a few guns in a safe in a house I still own in Seattle.

Wondering with the 594 crap, if a friend can go to a gun shop/ffl and have the guns sent to me using whatever magic FFL's use for this.

Thanks!
Craig

Your 594 problem is when the friend goes to your house and touches the gun.

As far as mailing, you can mail a gun to yourself. Your friend cannot mail it to you without sending it to an FFL.

Madpick is right.

Or book a round trip flight for one day, a rental car, and get your stuff.

Thanks all. Think I will fly out sometime and go to a gun shop and have them send to another gun show near me here in AZ.
I don't want to bother with guns on a plane. I know it isn't a big deal, but would rather never have to deal with it.

Hi Craig. I recently looked into purchasing another forum members 5906. The FFL shipping charges were typically $75 for one way shipment to Texas. That cooled my jets pretty quick. You might want to look into typical charges.

Other option is to make a road trip to pick up your guns. Just skip driving through any part of California on the way back to stay out of jail  One road trip option might be I-84 past Hood River & Snake River then go through Salt Lake City & Moab. Take a scenic detour to Monument Valley then back into AZ. Probably a bit out of the way but definitely the scenic route, couple great National Parks in Utah, and lots of wide open road for hauling ass in gun friendly states.

Plus there's great breweries in Hood River (Full Sail) and also Moab, Utah.

ATF sez: can ship them to yourself if moving to another state.
Don't need to go through an FFL. Just like when hunting in another state.

May a person who is relocating out-of-State move firearms with other household goods?

Yes. A person who lawfully possesses a firearm may transport or ship the firearm interstate when changing his or her State of residence. If using a moving company, the person must notify the mover that firearms are being transported.

Certain NFA firearms must have prior approval from ATF before such firearms may be moved interstate. He or she should also check State and local laws where relocating to ensure that movement of firearms into the new State does not violate any State law or local ordinance.

May a nonlicensee ship firearms interstate for his or her use in hunting or other lawful activity?

Yes. A person may ship a firearm to or herself in care of another person in the State where he or she intends to hunt or engage in any other lawful activity. The package should be addressed to the owner “in the care of” the out–of–State resident. Upon reaching its destination, persons other than the owner may not open the package or take possession of the firearm.

A direct family member may ship them also. Father, mother, son, daughter.

Good thing you boxed up all the Trust's stuff and left it with a listed Trustee of your Revokable WA Living Trust before you left town with a prepaid UPS shipping label attached to the box so they could send the trust's assets to you once you relocated to AZ. You know, to avoid all the 594 hoopla :thumbsup2:

If it's actually your stuff, you're overthinking it, no FFL would be needed to take possession of your firearms. If its stuff you're buying from someone else in another state (WA) that would be a crime to ship it directly to you in AZ without using a FFL on the receiving end.

If it was me, I'd just fly up, and either fly or drive in a rental car depending on how many firearms you're talking about. 2- 5 = fly. More then 5 = drive. Tacoma to Tuscon via Boise is 2 long days of driving. Not my favorite trip, but it's doable. Might be shorter cutting through central OR to the west side of NV and down, Ive never gone that way.

Google maps offers 2 routes, neither goes through CA, both are 24hrs of driving

Where did you get that information from?

Probably from the fact that direct family members are exempt from 594 when it comes to a "transfer".

If I were the OP I'd just buy an old Military footlocker, secure the weapons inside with plenty of "dunnage" and padding, lock it up and check with the airline when flying. If the weapons are smaller just use a smaller container. The cost of a plane ticket would be a whole lot less than a rental car and all the drive time. A fly/drive means a one-way rental and some of them can get pretty expensive with the "drop off charge".

Guys who compete take lots of firearms with them as they fly off to matches. Airlines are used to it.

Now if you want to bring the safe with you, the airline might complain

Had a shotgun when I moved up here and was told to have my father just slap it in the mail via UPS by the FFLs I was going to deal with. After reading very carefully though the laws it seemed that way as well when it came to "transfers" in both states it was in.

this one can twist the mind.....if the friend gains access to the guns, the friend is not in trouble, the owner who gave them access is in violation of 594, but the owner was/is not in Washington, so Washington's law cannot apply to the owner who provided access...amiright?

Also I thought that 594 was only supposed to apply to transfer of ownership not transportation, otherwise UPS, FED-Ex and anyone else involved in the transporting of firearms would be in violation of the law.

Interstate transfer of a firearm without an FFL?
