Now it is possible if they were in close quarters the perp could try to take their gun, and it could be justified, but I'm interested to see what this investigation turns up.

From what I've seen, many states consider the offensive (as opposed to defensive) use of pepper spray to be a crime - so, I'd say it's justified.

Yes you can use lethal force in defense of pepper spray.

If you look at the situation. Pepper spray can and will likely make you unable to defend yourself and vulnerable for the BG to take your weapon and turn it on you and/or take other measures against you.

Bottom line. Totally justified.

I'm interested in seeing a case of where pepper spray was used and they weren't in close quarters. Also the way cops see it. If you try to harm or incapacitate them in any way they will likely shoot you.

ETA: I guess you could make an argument if someone maybe shot it off a bridge or a balcony or something to that affect.

If someone pepper sprayed me, I would use lethal response (if'n I could SEE that is....O.o) who knows what other unpleasantries they may have in mind...O.o

If you spray me at work I will use lethal force. Because if I don't I know I will be dead in the next 30 seconds.

I love how they say how horrible the officers injuries were, how his 'face was burned and required medical treatment'...

But they'll do the same to people sitting on a sidewalk not doing anything...

Well that's my point. The police pepper spray protestors without justification, so are they permitted to use a lethal response?

I've always heard that using "less lethal" is a way to avoid situations escalating. And that "no one ever get arrested for using pepper spray".
And that pepper spray is a defensive weapon.

I don't agree with attacking the police of course.

But let's spin a scenario and leave out the police:

A 400lb guy blocks a woman's car in at the casino. He's open carrying, and screaming at her because he's a nut job or whatever. But he hasn't drawn his weapon. So she pepper sprays him to buy time to get the eff out of there. And then he shoots her because he was sure she was going to take his gun and kill him, and claims it was a justified response. Justified?

Probably not, because I doubt that scenario would pass the "reasonable person" smell test.

A few people here saying they'd respond to pepper spray with lethal force. How does the "reasonable person" delineate between an offensive and defensive use of pepper spray and whether to respond?

We're told and conditioned it is a "defensive tool"....

I believe those people were operating under the assumption that they were not the aggressor in the situation, nor had created a situation whereby deploying pepper spray would be a legal act. When deployed in an aggressive fashion, it may very well be legal and correct to use lethal force in self defense depending on the circumstances attendant to the attack.
