I'd treat it as a real gun until the thug was neutralized, then verify plasticity.
I vote for .Gov employees to tell Us, The People, to fight back at evil wherever it rears its ugly head. We are all ultimately responsible for our own well-being. They know it, and occasionally some of them are courageous enough to remind us of that. Even the courts have said it. |

If he knew it was a toy gun and had some sort of fighting skills then by all means have at it. However he probably should have had a real gun if it was going to take on a criminal regardless.
