They haven't updated the site yet, other than add a link at the top of the page to point out the changes. Try this. The bill as signed into law. http://lawfilesext.leg.wa.gov/biennium/ ... 9-S.SL.pdf

I quickly looked at it without looking at the date. I foolishly assumed the ***hats in the government would have made the transition. Silly me. Rather than amend my prior post, apparently, the new law is here. http://lawfilesext.leg.wa.gov/biennium/ ... 9-S.SL.pdfInteresting language. Quote: (c) "Use" or "uses" means:23 24 (i) Holding a personal electronic device in either hand or both hands;25 26 (ii) Using your hand or finger to compose, send, read, view, 27 access, browse, transmit, save, or retrieve email, text messages, 28 instant messages, photographs, or other electronic data; however, 29 this does not preclude the minimal use of a finger to activate, deactivate, or initiate a function of the device;30 31 (iii) Watching video on a personal electronic device.
Quote: Sec. 3. A new section is added to chapter 46.61 RCW to read as follows:2 3 (1)(a) It is a traffic infraction to drive dangerously 4 distracted. Any driver who commits this infraction must be assessed a base penalty of thirty dollars.5 6 (b) Enforcement of the infraction of driving dangerously 7 distracted may be accomplished only as a secondary action when a 8 driver of a motor vehicle has been detained for a suspected violation 9 of a separate traffic infraction or an equivalent local ordinance. (c) For the purposes of this section, "dangerously distracted" 11 means a person who engages in any activity not related to the actual 12 operation of a motor vehicle in a manner that interferes with the 13 safe operation of such motor vehicle on any highway.

Most here know I am generally pro LEO, but people debating or doubting about the way this law can be abused take note.
Wife came home lastnight and reported that one of her coworkers was pulled over for drinking a milkshake. This was FIFE if course and their draconian ways are well known, but just goes to show that this law can be abused at officers discretion. He got off with only a warning thankfully, but I find that a bit disappointing. The cop was sitting by the Jack n the box apparently, and stopped him somewhere right there along hwy99 after he pulled out.
Another coworker was pulled over for having her phone in her hands. Most people should know given the news coverage on this law that is a no-no with way this current law reads, but what is disappointing is one of the responses the officer gave her during the stop. She commented that she was not talking on the phone. Rather than inform her that the new law that does not matter, it is not legal to hold the phone while on the road he told her this: "I cannot prove you were not talking on the phone." Hrmm so much for innocent until proven guilty.?

Example: OJ gets parole having served less than 30% of sentence and lies to parole board as well as showed zero remorse means laws are pointless if penalties are so 'fluid'.
If driving distracted is such a danger then one could reasonably argue fear for one's safety and/or life then deploy defensive counter measures. Problem would clear up real quick after a few dozen such events.

FUCK THIS LAW... there was already law on the books making it illegal to use your phone while driving.
Saying somebody can't have a sip of their coffee/pop/water while driving is bullshit. THERE ARE FUCKING CUP HOLDERS IN ALL OF MY CARS....
Somebody having a cigarette while driving is their business, not LEO's.
I agree that folks shouldn't use their phone while driving, but we already have that law on the books. This is a fucking money grab!
Any "law" that doesn't apply EQUALLY to all citizens is bullshit, pure and simple. I hope this shit gets ground to crap in court. I support LEO, but having them exempt from laws that they enforce is cause for revolt in my opinion.
As if I needed another reason to HATE this fucking state... JFC!

Today I ran into an issue where the phone would have just been faster. I can use my in dash system to pull up a number from my phone's phonebook and dial it. Took me more time to use the dash then my phone, and my eyes were off the road more too then had I just used my phone. Since I don't do the dash action that much I'm spending more time looking for the buttons I needed to push instead of just using my phone. I also ended up where I needed to pick a number to reach the person I was trying to call, my in dash buttons weren't registering what I pressed, so I had to use my phone for this. Trying to do the right thing, but it was more of an issue. This law is stupid. I get that it is trying to prevent loss of life, but unless phones are designed to not operate while in moving vehicle people are still going to text and screen watch, and lives will still be lost.

Personal liberty and personal responsibility are out of favor in this century I guess. Stop trying to make life perfectly safe. Life is good and it sucks and it is not fair. Life is dangerous. Safety Third. Liberty and Responsibility are First and Second in my book.

My neighborhood is 25mph, and always has kids and adults walking and biking and skateboarding on the shoulder. There is no sidewalk.
Yesterday, I'm in front of my house at the end of the driveway. On my bike, dog leash and dog ready to go for a ride/run. There are a few 10-15 year old kids on bikes next door, at the edge of the road where they tend to ride and play.
As is often the case, this trashy woman flies by at 35mph or more. Two adults in the drivers seat, and several kids in the back. She doesn't bother slowing or swerving for any of us, and has her monster sized cell phone stuck to her head with her arm holding it up.
She was on her phone, and hence IGNORING all of us at edge of the road. Didn't bother slowing or swerving at all.
I hope she gets a ticket as with everyone else breaking this law. I hope they all get tickets and ultimate big fines and in the end lose their licenses. I 100% support the law. I walk and bike enough to see the real threat of these distracted morons making their important calls and texts to order a pizza and check their FB status... while killing ordinary folks out walking their dogs.
I'm sick of these idiots on the roads, wasting MY time and putting everyone in danger. They sit at stop lights checking their FB. They fly through intersections. They speed. It can be drastically reduced by this... and I say good.

Fucking Fife officer dipshidiot doing prisoner transport on I5 called state patrol because I was in a grand marquis, with antennas, and an amateur radio license plate.... Fucker pulled me over, turned off my dash cam, hung up on my brother (was on phone call via BT), then accused me of pulling badges on people. State showed up and pretty much told the Fife officer to fuck off... Probably had to do with the fact I was working on a WSP BMW with a failed siren system not that long before.... Mediumrarechicken wrote: I'll keep doing what I do, this law is stupid. Yup. Mediumrarechicken wrote: I already always look out for cops because I speed all the time, this is nothing new You and everyone else. And that's the whole point. Speeding is already against the law, everyone knows it, and everyone still does it. Everyone also knows that doing anything other than just driving is a distraction, and now that's it's against the law, it's not going to matter - they'll do what they want anyway. Other posters already nailed it - this is a revenue scheme, nothing else.

Murder is bad. Maybe we should make some more laws against that too.
Probably be as effective as 594 or the 25 foot smoking ban.
