cancelling your gym membership

Fri Feb 17, 2017 10:35 am

I thought this was just fodder for sit coms, but recently I tried to cancel my daughters LA Fitness gym membership and found out that they will not allow you to do so and the law is on their side!

I tried twice in person, but the special "manager" who is the only one who is authorized to cancel memberships is NEVER available, you cannot cancel over the phone or online,

I called my credit card company and disputed the charges, they went ahead and sent a message to LA Fitness, but said it wont do any good and even if I cancel my credit card, they can still bill my account and send me to collections.

I am two steps from resorting to violence, so I thought I would consult you folks to see if anyone had some advice in dealing with these mother fuckers

What is the law? Can you cancel in writing?

How To Cancel a Membership

Washington's Health Club law provides specific reasons and methods for cancellation. A couple of tips you should consider are:

You must mail or deliver a WRITTEN notice to the club saying you want to cancel;
If you are canceling under the three-day right to cancel and are mailing the notice, it must be postmarked by midnight of the third day;
When mailing any cancellation notice, you should ask for a "return receipt" at the post office so you have proof the notice was received. Be sure to keep a copy of your cancellation request;
If you hand-deliver the notice to the club, ask an employee to initial and date your copy of the notice, showing it was actually received;
After you have properly cancelled your membership, you are under no obligation to continue making contract payments. However, you may still be obligated to pay the initiation fee after canceling the membership if you financed the initiation fee and signed a non-refundable clause.

Sorry to hear this brother. Sounds a lot like trying to cancel a Yellow Pages listing back when those were relevant. They would always tell you it was canceled on the phone, but you never send you anything concrete so it was always "he said, she said" later when they renewed you for a year.

Health Club Tips

Within three (3) days after signing a contract, you can cancel your membership for any reason.
Cancellations must be in writing, and after receiving your written cancellation notice, the club has 30 days to refund your money.
At any time during your membership, if your contract runs for more than a year, you can cancel by giving 30 days written notice.
If your contract is later than one year, and you move more than 25 miles from the health club, you can cancel if no affiliated club within 25 miles of your new residence offers the same services at no additional charge.
If the health club closes permanently, and the owner does not have a comparable facility within 10 miles of the club, you can cancel and receive a pro-rated refund of your initiation fee.
If equipment or services which were promised in the contract are not completed by the date specified in the contract are not completed by the date of the contract, you are entitled to a full refund of your membership fee.

You guys are not going to believe this....I got a call this morning from a manager at LA Fitness, she said they were notified about my complaint to the WA AG's office and wanted to fix the problem immediately. They cancelled my Daughter's membership, provided me a credit and sent me a confirmation email all within a few minutes.

It appears that filing a complaint with the AG does actually work! I imagine I was not the only complaint on file, but I got results pretty quick (I filed the complaint on Friday).

It would appear you aren't the only one....98% negative reviews at the BBB:

Feel free to submit your own review of your experience to the BBB.

BBB will change an F rating to A- for about $1,500+ depending on how many complaints they have.
Their ratings can't be trusted.
Many companies that were closed down and prosecuted for fraud still had perfect ratings.

Which is one reason I didn't even mention their ratings. I mentioned reviews. And the business in question has a 98% negative review rate. You can go read some of the reviews, they are dismal.
